New York City Lawyer For Traffic Violation Appeals

If Your New York Or CDL Driver's License Has Been Suspended, You Can Appeal

Remember, when it comes to driving in New York, holding a driver's license is a privilege earned, not a right protected by the state. That does not mean, however, that you give up your right to appeal the Department of Motor Vehicles' (DMV) decision to suspend your license.

If you feel your DL or CDL was wrongfully suspended or revoked, call the New York City traffic law firm of Katz Lawyers, with offices in Manhattan and Staten Island. For more than 15 years, attorney Seth Katz has been successfully defending the driving privileges of drivers throughout the state of New York.

Request A Hearing

Your DL suspension or revocation appeal begins at your local New York Traffic Violations Bureau (TVB). Having the right lawyer represent you can often mean the difference between success or failure. At Katz Lawyers, we handle everything. We know what details must be presented to get a hearing successfully scheduled. And when it comes to attending the hearing, we will go on your behalf, so you won't have to take a day off of work.

The Hearing

Prior to attending the hearing, we will thoroughly investigate the circumstances leading to the DL suspension, including your past driving record. The hearing official may make an immediate decision regarding lifting or continuing the suspension or may return his or her decision within a few weeks.

If an unfavorable decision is returned, you have the right to submit a further appeal, within a 30-day deadline.

Reinstating A Suspended Commercial Driver's License (CDL)

Appealing to reinstate a CDL in New York depends in large part on the reasons for the suspension or revocation. First, you will be required to demonstrate that you meet the minimum standards set out by the Federal Motor Carrier Safety Act (FMCSA). The appeals process follows many of the same steps, including requesting a hearing and paying all applicable fees.

It is important to remember, however, that if you are recognized as a CDL repeat traffic offender or have been charged with a serious traffic violation, you may be required to suffer additional penalties prior to CDL reinstatement.
